Terms and conditions
As a user of JTOpen and/or the AS/400 Toolbox for Java, you are invited to participate in the JTOpen/Toolbox for Java Forum, a discussion facility that puts you in touch with other users of JTOpen and the Toolbox. The topics of discussion are controlled by you and other users of JTOpen and the Toolbox. We are optimistic that this forumwill provide value to you as you exploit the capabilities of JTOpen and the Toolbox.
A Feedback facility is provided on each page of the Internet facility. As always, your comments and suggestions for improvement are important to us.
Terms and Conditions: JTOpen/Toolbox for Java Forum
IBM is making this forum available to customers interested in JTOpen or the AS/400 Toolbox for Java to facilitate a technical exchange of information, views, and questions (collectively referred to as "Messages") about JTOpen/Toolbox technical information. This forum is intended primarily for use by IBM customers, not by employees of IBM or IBM's subsidiaries. IBM provides this discussion group solely as a courtesy to our customers and reserves the right to discontinue the discussion group at anytime without notice.
By submitting Messages to this discussion group, you grant IBM and its subsidiaries the worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license touse, copy, distribute, display, and create derivative works from the Messages. You warrant that the holder of any intellectual property rights to the Message, has completely and effectively waived all such rights and granted you the rights to grant the licenses described in this paragraph. You also permit all users of this discussiongroup to access, display, view, store, and copy the Messages. All Messages that you submit are considered non-confidential. Do not post a Message unless you areauthorized to grant IBM and JTOpen/Toolbox for Java Forum users the right to use it as described above.
The opinions, advice, and other information expressed in Messages to the discussion group represent the views of their authors and not of IBM. Those using thediscussion group do so at their own risk. IBM shall have no obligation to monitor, edit, or censor Messages. IBM has no plans to regularly pre-screen Messages before they are posted nor to review posted Messages for compliance with the rules described below absent receipt of a legitimate complaint. IBM shall not, under anycircumstances, be responsible or liable for any inaccurate, abusive, obscene, profane, defamatory, libelous, infringing, or illegal material posted on the discussion group.Notwithstanding the foregoing, IBM reserves the right (but shall not have the obligation), in its sole discretion, to review Messages, to remove, or refuse to post any Message, or to revoke any user's access at any time.
In using the discussion group, you may not do any of the following:
- Post or transmit information that is not related to technical topics associated with JTOpen or the AS/400 Toolbox for Java.
- Post or transmit any defamatory, libelous, unlawful, fraudulent, infringing, or knowingly false information of any kind.
- Post or transmit any abusive, obscene, profane, sexually explicit, or threatening Messages of any kind.
- Use the JTOpen/Toolbox for Java Forum for solicitation or advertising.
The IBM JTOpen/Toolbox for Java Forum sponsor may review the Messages posted to the discussion group and periodically comment to prompt discussion or provide technical information. However, the JTOpen/Toolbox for Java Forum is not designed as a means to provide customers with direct IBM product support. IBM has no obligation to comment on information or respond to questions. IBM's failure to respond to inaccurate information does not mean IBM agrees with such information.
THE JTOPEN/TOOLBOX FOR JAVA FORUM AND ALL INFORMATION PROVIDED THEREIN ARE PROVIDED STRICTLY ON AN "AS IS" BASIS, AND IBM DISCLAIMS ANY AND ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
Under no circumstances will IBM be liable for any damages, including any direct, indirect, incidental, special, exemplary, or consequential damages (including lost profits) for your use of or inability to use the JTOpen/Toolbox for Java Forum, or your reliance on or use of information provided through the discussion group, or that result from mistakes, omissions, interruptions, deletions, errors, defects, delays in operation or transmission, or any failure of performance. If you are dissatisfied with the JTOpen/Toolbox for Java Forum in any way, your sole and exclusive remedy is to discontinue using the discussion group.
IBM reserves the right to change these Terms and Conditions from time to time in IBM's sole discretion. Your continued use of the discussion group shall be subject to the Terms in Conditions published by IBM at the time of such use.
IBM reserves the right to terminate or change this discussion group at any time without notice.
This Agreement shall be governed and construed in accordance with the law of New York, USA. You agree that any and all disputes arising out of or in connection with this customer roundtable will be brought exclusively in a federal or state court located in New York and will be tried without a jury regardless of the form or type of action.
